Joe Biden officially secures enough electors to become president

    AP

California certified its presidential election Friday and appointed 55 electors pledged to vote for Democrat Joe Biden, officially handing him the Electoral College majority needed to win the White House.

Secretary of State Alex Padilla's formal approval of Biden's win in the state brought his tally of pledged electors so far to 279, according to a tally by The Associated Press. That's just over the 270 threshold for victory.

These steps in the election are often ignored formalities. But the hidden mechanics of electing a U.S. president have drawn new scrutiny this year as President Donald Trump continues to deny Biden's victory and pursues increasingly specious legal strategies aimed at overturning the results before they are finalized.

Although it's been apparent for weeks that Biden won the presidential election, his accrual of more than 270 electors is the first step toward the White House, said Edward B. Foley, a law professor at Ohio State University.

"It is a legal milestone and the first milestone that has that status," Foley said. "Everything prior to that was premised on what we call projections."

The electors named Friday will meet Dec. 14, along with counterparts in each state, to formally vote for the next president. Most states have laws binding their electors to the winner of the popular vote in their state, measures that were upheld by a Supreme Court decision this year. There have been no suggestions that any of Biden's pledged electors would contemplate not voting for him.

Results of the Electoral College vote are due to be received, and typically approved, by Congress on Jan. 6. Although lawmakers can object to accepting the electors' votes, it would be almost impossible for Biden to be blocked at that point.

The Democratic-controlled House and Republican-controlled Senate would both vote separately to resolve any disputes. One already has arisen from Pennsylvania, where 75 Republican lawmakers signed a statement on Friday urging Congress to block the state's electoral votes from being cast for Biden. But the state's Republican U.S. senator, Pat Toomey, said soon afterward that he would not be objecting to Pennsylvania's slate of electors, underscoring the difficulty in trying to change the election results through Congress.

"As a practical matter, we know that Joe Biden is going to be inaugurated on Jan. 20," Foley said.

That was clear in the days after the election, when the count of mail ballots gradually made clear that Biden had won victories in enough states to win the Electoral College. It became even more apparent in late November, when every swing state won by Biden certified him as the winner of its elections and appointed his electors to the Electoral College. Trump has fruitlessly tried to stop those states from certifying Biden as the winner and appointing electors for the former vice president.

He made no effort in deeply Democratic California, the most populous state in the nation and the trove of its largest number of electoral votes. Three more states won by Biden — Colorado, Hawaii and New Jersey — have not yet certified their results. When they do, Biden will have 306 Electoral College votes to Trump's 232.

Trump and his allies have brought at least 50 legal cases trying to overturn the results in the swing states Biden won — mainly Arizona, Georgia, Michigan, Pennsylvania and Wisconsin. More than 30 have been rejected or dropped, according to an AP tally.

Trump and his allies have also raised the far-fetched notion that Republican state legislatures in those states could appoint a rival set of electors pledged to Trump.

But state Republican leaders have rejected that approach, and it would likely be futile in any case. According to federal law, both chambers of Congress would need to vote to accept a competing slate of electors. If they don't, the electors appointed by the states' governors — all pledged to Biden in these cases — must be used.

The last remaining move to block the election would be the quixotic effort to vote down the electors in Congress.

This tactic has been tried — a handful of congressional Democrats in 2000, 2004 and 2016 objected to officially making both George W. Bush and Trump president. But the numbers were not enough to block the two men from taking office.

Kellyanne Conway appears to be admitting defeat. In an interview, she said:

"We want the engines of government to keep going, and you always need a peaceful transfer of democracy no matter whose administration goes into whose administration, there's no question. If you look at the vote totals in the Electoral College tally, it looks like Joe Biden and Kamala Harris will prevail,"

Pretty much the only sane thing the woman has ever said

Thank you again Sandy... And Jacksie.... you can DO this... I was addicted to Neo-Synephrine MANY years ago, but I didn't think about this, when I kept using the Afrin! I just thought, well it's sold over the counter, so it's okay, so I will use it whenever I need it, which was like every 4 hours, or less. Never mind what the directions said.

I was in a panic that first night, when I went "cold-turkey" without the spray. Like I said, the steam from boiling water, another phone call to yet ANOTHER pharmacist, & just trying to BREATHE! Laying down was out of the question. I finally sat up and would breathe through my mouth. I relaxed.... and then I noticed..... my mouth was not wide open! And I could breathe a little with my nose! So I piled up my pillows, tried laying down again..... and if I put my hands around my face, like holding my nose open, I could breathe some air with my nose!

Next morning I just used the saline spray! Not GOOD yet, but I COULD BREATHE! Pharmacist said it would take "a couple days"... I did it in one day. Scared the living hell right out of me! I am so afraid to ever even LOOK at my stand by "safe" generic for Flonase!

I have my Daughter's little MyPurMist, but Vick's sells one that is a lot cheaper, and I ordered one. But breathing steam is the best!

It's like Sandy saved my life! When someone has gone through the same thing you are, it really helps to listen.

Now Sandy.... If I could get DOWN in a tub, and then get back UP..... and breathe steam like that, it would be a miracle... Hah! I have copied and pasted all of your advice, and keep it for reference IF I temporarily lose my mind, and even THINK of using that devil nose-spray again!

So good luck Jacksie.... You got this!

And here's another stupid idea you never want to try... See, I lost my hearing after taking Tamoxifen for a year and a half. A stroke, near the 8th cranial nerve... So I can hear with hearing aids. But then someone, told me about ear candles, and how they remove ear-wax!

I thought, well, then maybe I could hear again! Maybe THAT'S the problem... Maybe they are just both plugged! I became addicted to them.... too.

So after my 10th order of candles, I read somewhere, "stick a lit ear candle in a pot of dirt, let it burn, and cut it open, and you will see all the "wax" at the bottom... like it actually DIDN'T come from your ear, but the candle wax burning itself, down to the end! I never used another candle again... I just thought that "wax" at the bottom was from my ear! And NOT from the burning candle!

See, if left to my own self, I can do more damage than any doctor ever dreamed of!

A primer on presidential family pardons

By Aron Solomon, Opinion Contributor, The Hill, 12/05/20 09:00 AM EST

In an earlier piece, I predicted that one of the things Donald Trump would do as a lame duck president is begin to pardon a lot of people, ultimately perhaps himself. This week finds him warming up his pardon pen, with talk of his active consideration of pardons for his family becoming viral on social media.

What follows is a quick primer on the presidential pardon power and how it applies to any pardons involving his family.

Can a president grant preemptive pardons? Yes.

"A preemptive pardon is a presidential pardon granted before any formal legal process has begun," American University professor Jeffrey Crouch commented to National Public Radio this week.

In other words, let's assume that a member of the president's family has committed a federal crime. Given that the crime has already occurred, it can now be pardoned. The notion that a president must wait until the person is charged with the crime, indicted, pleadings are filed, there is a trial and so on, is a legal fiction.

Even if he pardons his family? Seemingly yes.

It is clear that family pardons are something President Trump is considering.

President Clinton issued a pardon for his half-brother Roger Clinton after he served a year in prison for pleading guilty to cocaine distribution charges. The pardon was one of 140 Clinton issued on his last day in office and the only presidential family pardon currently part of our nation's historical record.

However, back to the point above, if President Trump pardons his family, what would be truly unprecedented is that he would be pardoning family members who are not currently accused of federal crimes. This is where things really become historically interesting.

Both so true on the above memes and all of them lately have been fantastic. I think Biden got over 51 % of the vote which actually puts him WELL ahead of Trump. It is and was a landslide for Biden. All of the Democrats coming out to vote -- and it was SO important that in almost all of the states, it wasn't really close. I mean here we are putting up with endless, it seems, lawsuits that prove nothing -- usually getting thrown out. Think how that would be if many of the states were close in vote counts. Makes me so glad that the warning that the Democrats should vote early and in the highest numbers possible came out.

It does bother me that it took such a crisis to get that many people out to do their duty but bless them all for doing so at a time when we are in the worst pandemic ever. Heart-warming to know that there are so many good people who were determined to change what the idiotic Reps. in the Senate refused to do. Speaking of that I do wonder that some of them may have a lot of regrets.

I was amazed that the Reps. down ballot did as well as it did. I am thinking that many of the Reps. didn't perhaps vote for President, but took care of the rest of the ticket by voting straight ticket at that point. It may be interesting to see what happens to those coming up in the 2022 cycle -- especially with how Trump is handling things right now. That said, I wonder if he will turn the 'rally' for the run-off into a giant rant over all the mean people who won't hand him the office he now has to vacate and the horrid GA Reps. who are front and center. Can anyone make that thing behave now ??

There is actually someone in my neighborhood with a HUGE trump flag waving from a tree in his front yard. And he still has a lawn sign too. Several people have called since signs aren't technically allowed other than "for sale" signs. It pisses me off every day when I walk. Since this guy is a general A.H. anyway, the president of the subdivision thought it would be better to wait until 12/14 rather than get in a fight. I certainly won't tackle him personally, but I will sic the management company on him.

Edited to say - he'll probably just put it on one of his trucks and drive around with it. Who knows, he may put his huge confederate flag on the other side of the truck.

GOP needs a vaccination for reality and honesty, but none is in the horizon. Washington Post Survey of Republlican congress, 27/249 acknowledge Biden as Winner, 2 said Trump won, and the rest are too chicken-shit to give and answer. Worse, Trump has tweated demanding to know who the RINOs are.......... https://www.washingtonpost.com/politics/survey-who...

Even with Biden in office,, the next four years could be really shitty with a republican congress blocking everything. I'm not from Georgia but am rooting for Warnock and Ossoff and have contributed to their campaigns. Please consider doing the same

Everyone here will be rooting for the Democrats to wins. Not only because we would have control of the Senate pretty much, but of course McConnell would lose his position and be minority leader. One of the main issues is that the Reps ( if at all possible ) don't want Democratic presidents to have too many wins at all. So, we really do need to be able to demote McConnell.

I do think Biden would get things done because Trump did a lot of things that should never have seen the light of day and while they didn't cross him I think silently many of the Reps. were upset about those things -- like pulling our troops out of Syria and leaving the Kurds to fend for themselves. Still, I think it could be something of a fight all the way. I also feel the further away from the election things may cool down more -- when the Reps. don't have to spend a part of every day trying to defend something Trump has done or said. They may come to like that part of their life. I think they did like the fact that Trump ignored norms even though they had to hold him up a lot when he did it, but in the end I'm sure they got tired of trying to duck reporters in the halls. They may find that they like the 'normal' we once had in that way.

Also, their behaviors will hopefully improve a bit if they suddenly have to be a bit more accountable because standards have been raised.
